Do I have a Personal Injury Case if I had a Pre-existing Condition?

I wanted to provide you with a little information about what to do after a car accident and also what happens if you had a prior injury or preexisting condition that was aggravated in that accident. A lot of people ask me, “you know I had a prior neck problem I was seeing a Chiropractor and then I get hit by a car and it got a lot worse. Do I have a claim?” My answer is yes, you still have a claim. In Florida, you can recover for aggravation of a preexisting condition. So, just because you were injured before or had a prior medical condition that got worse from an accident it doesn’t mean that you’re banned from making that claim. You can still make a claim for the additional pain and suffering and the additional treatment that you’re going to have to undergo because of the negligence of the other driver.
